Terms of use

These terms apply to navigationatlas.com and its sub-domains (the "site"), published by Ultra Task Pty Ltd, ABN 93 700 712 910, ACN 700 712 910, Gold Coast, Queensland 4226, Australia ("we", "us"). By using the site you agree to them. If you do not agree, please do not use the site.

1. What the site is

A free information service showing published figures about inland waterways on a map. It is information only, not for navigation: see the navigation disclaimer, which forms part of these terms. We may change, suspend or withdraw any part of the site at any time.

2. Information and sources

Most information comes from third parties: navigation authorities, open-data publishers and OpenStreetMap contributors. Each figure shows its source and date. The publications of the competent authority always prevail over anything shown on the site. To the extent the law allows, the information is provided "as is", and we do not promise that it is accurate, complete, current or usable for any particular purpose.

3. Your responsibilities

You are responsible for your boat, your crew and your navigation decisions; for checking the charts and notices of the competent authority for your route; and for complying with local rules (licences, permits, vignettes, speed limits, equipment).

4. Links

The site links to third-party sites, including the publishers of the data. We are not responsible for their content, products or services. Trade marks mentioned belong to their owners; mentioning them does not imply endorsement or partnership, and no source listed on the site endorses it.

5. Intellectual property and open data

6. Acceptable use

Do not attack or overload the site, probe it for vulnerabilities without telling us first at support@ultratask.com.au, present our copy of a figure as a publication of the authority, or use the site unlawfully.

7. Liability

7.1 To the extent permitted by law, we are not liable for any loss or damage arising from reliance on information on the site instead of the publications of the competent authority, from the site being unavailable, or from third-party sites or services.

7.2 To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, business, bookings or opportunity. Where our liability to a business user cannot be excluded, it is limited to AUD 100 (or the equivalent in your currency).

7.3 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be excluded or limited by law, nor your statutory rights as a consumer, including under the Australian Consumer Law, the UK Consumer Rights Act 2015, the French Code de la consommation or other law of your country of residence that cannot be set aside by agreement.

8. Corrections and complaints

Report errors in the data, with the source, to support@ultratask.com.au. We correct confirmed errors in the next build.

9. Changes

We may update these terms; the date above shows the latest version.

10. Law and courts

These terms are governed by the law of Queensland, Australia. If you are a consumer, you also keep the protection of the mandatory rules of your country of residence and may bring proceedings in the courts of that country.
